Terms of service

The deal

Unfunnel is operated by Tenek LLC ("Unfunnel", "we", "us"). Unfunnel gives you a builder, AI drafting on paid plans, hosting for the funnels you publish, and reporting on the visitors who use them. You give us accurate account details, pay for the plan you choose, review what you publish, and use the product lawfully. That is most of it. The rest of this page spells it out.

These terms are a binding agreement between you and Tenek LLC. You accept them by ticking the box when you create an account, and again whenever you keep using Unfunnel after we update them. If you sign up for a company, you confirm you can bind that company, and "you" means the company too. Our privacy policy and AI disclosure are part of these terms.

Your account

• You must be at least 18 and able to enter a contract.
• You are responsible for what happens under your login and for keeping it private. Turn on two-factor authentication in Settings if you want a second lock.
• Workspaces are shared. Anyone you invite can act within that workspace under these terms, and you are responsible for who you invite.
• API keys and AI assistant connections act as you. Keep them secret and revoke any you no longer use.

Your funnels and your leads

Everything you build and every lead your funnels capture belongs to you. You grant us only the licence needed to host, display, back up and deliver it, and to show a funnel's public pages to the visitors you send there. You can export all of it at any time, and deleting it in the app deletes it from our systems.

You are the data controller for the people who fill in your funnels. That means you are responsible for asking only what you are allowed to ask, for showing the consent, cookie and legal notices your jurisdiction and your visitors' jurisdictions require, for linking your own privacy policy and terms from the Compliance tab, and for honouring requests from those people. Unfunnel provides the switches; you decide which are on.

Funnels on the Free plan carry a small "Made with Unfunnel" badge. Paid plans remove it.

AI drafting

On paid plans, and during set-up on Free, Unfunnel can draft a funnel from a description, edit it from an instruction, and read your website to pick colours, fonts and wording. It does this by sending your instruction, the funnel document and any website text you point it at to Anthropic's Claude API. Our AI disclosure describes exactly what is sent and kept.

AI output is a first draft, not advice, and not a finished product. It can be wrong, generic, out of date, or similar to what it drafts for somebody else. In particular, we do not promise that AI-drafted copy, headlines, questions, forms or layouts are accurate, original, or compliant with advertising law, truth-in-advertising rules, the ad platform policies that apply to your traffic, health, financial or other regulated-claims rules, or anyone's intellectual property. You must review everything the AI produces and are solely responsible for what you publish, whoever or whatever wrote the first version.

• You own your instructions and the funnel documents you give the AI. As between you and us, you own the output it returns to you, subject to the point below.
• Because the same model drafts for every customer, it may produce similar or identical wording, structure or ideas for other customers. We cannot grant you exclusivity over any AI output, and you must not claim rights in it against other Unfunnel customers.
• Do not put anything into an AI instruction that you are not allowed to share with a third-party processor: other people's personal data beyond what a funnel needs, confidential information you hold under a duty of secrecy, or material you do not have the right to use.
• Do not use the AI to produce anything that would break the acceptable use rules below, and do not try to extract the model's instructions or use the feature to build a competing model.
• Neither we nor Anthropic train models on your instructions, documents or leads.

Acceptable use

You may not use Unfunnel, its AI, its hosting or its API to:

• Publish anything unlawful, deceptive, defamatory, hateful, sexually explicit or infringing.
• Build phishing pages, impersonate another business or person, or collect passwords, card numbers, bank details, government ID numbers, one-time codes or similar credentials. Our publish check refuses forms that ask for these.
• Promote scams, get-rich-quick or pyramid schemes, counterfeit goods, or products and claims that are illegal where they are sold or shown.
• Collect data from anyone under 16 without a lawful basis, or knowingly target children.
• Send messages, including SMS and email follow-up, without the consent the law where the recipient lives requires.
• Run funnels that violate the advertising policies of the platforms sending traffic to them, or send an ad platform (Meta, ChatGPT Ads, Google Ads) data its terms forbid, such as health or financial details.
• Probe, overload, scrape or interfere with the service, other customers' workspaces, or the AI and API rate limits.
• Resell or sublicense Unfunnel itself, as opposed to funnels you build with it, outside the Agency plan's client workspaces.

We may refuse to publish, take down or suspend a funnel, and suspend or close an account, that breaks these rules or exposes us or others to legal risk, without notice where the situation calls for it and without a refund. Anyone can report a page published with Unfunnel; we review reports and act on them. We may also remove content in response to a valid copyright or trademark notice sent to hello@unfunnel.io.

Billing

• Paid plans bill in advance, monthly or annually, through Stripe. Stripe's own terms and privacy policy apply to the payment itself; we never see your full card number.
• A workspace's first paid subscription starts with a 7-day free trial; a workspace that has already had one pays from the start. Cancel before a trial ends and you are not charged. Otherwise the first payment is taken when the trial ends and the plan renews automatically until you cancel.
• You can cancel at any time from Settings. Access to the paid plan continues until the end of the period you have paid for. Payments are non-refundable, and we do not prorate partial months or years, except where the law where you live requires it.
• When a paid plan ends, for any reason, the workspace returns to the Free plan's limits straight away: funnels past the limit go back to draft (the most recently edited stay live), the Free badge appears, and the newest teammates lose access. Nothing is deleted, and you can export everything before or after. Upgrading again brings it all back.
• Failed payments keep the plan while Stripe retries. If the retries fail, the plan ends as above.
• If you dispute a charge with your bank instead of contacting us, we may suspend the workspace, and take its funnels offline, until the dispute is resolved. Please write to us first; we would rather fix it.
• Prices may change with thirty days' notice by email. A change applies from your next renewal after the notice period.
• Taxes: prices exclude VAT, sales tax and similar, which are added where they apply.

Data processing

Where you are the controller of the personal data in your leads and we process it for you, this section is our data processing agreement. We will:

• Process that data only to provide the service and as you instruct through the product, never for our own marketing or to train models.
• Keep it confidential, and make sure the people and services we use are bound to do the same.
• Use only the sub-processors listed in our privacy policy, and update that list, with notice to account holders, before adding one.
• Protect it with the measures described in the privacy policy, including encryption in transit and at rest.
• Help you answer access, correction and deletion requests from your visitors, with the export and delete tools in the app.
• Tell you without undue delay if we learn of a breach affecting your data.
• Delete it when you delete it in the app or close your account, subject to the backup schedule in the privacy policy.

Our servers are in the United States. If you or your visitors are in the EU, UK or another place that restricts transfers, you rely on our sub-processors' standard contractual clauses and equivalent safeguards. Email us if you need a signed copy of these terms for your records.

Tracking and third parties

Connecting an ad platform sends your funnel's conversion data to that platform under your own account and its terms: a Meta pixel or Conversions API to Meta, a ChatGPT Ads pixel or key to OpenAI, and Google Ads to Google. Connecting Google Ads also lets Unfunnel list the Google Ads accounts your Google login can reach and create conversion actions in the one you choose; our privacy policy says exactly what that access is used for. You are responsible for having the consent and notices those platforms and the law require for the data your funnels send them, including any customer data terms a platform asks you to accept.

Custom domains, calendar embeds, webhooks, the API, and AI assistants you connect over MCP link to services you choose and control. We are not responsible for how those services handle your data, for their availability, or for what an assistant does with the access you grant it.

Ownership of Unfunnel

Unfunnel, its templates, code, designs and name belong to us and our licensors. You get a licence to use them to build and run your funnels while you have an account, nothing more. Templates and sample content are shared across customers; you may use them in your funnels but not claim them as your own. If you send us feedback, we can use it without owing you anything.

No warranties

Unfunnel, including every AI feature and every AI output, is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, non-infringement, accuracy, and uninterrupted or error-free operation. We do not promise that a funnel will convert, that leads will be genuine, that tracking will match an ad platform's own numbers, or that any output complies with any law. Some places do not allow these exclusions, in which case they apply as far as the law permits.

Limitation of liability

To the fullest extent the law allows, we are not liable for lost profits, lost leads, lost data, lost business, fines from ad platforms or regulators, or any indirect, incidental, special, consequential or punitive damages, however caused, including from your reliance on AI output or from a funnel being taken down under these terms. Our total liability to you for everything arising from Unfunnel is limited to what you paid us in the twelve months before the claim, or one hundred US dollars if you paid nothing. Nothing here limits liability that cannot be limited by law.

Your responsibility to us

You will cover us, and our officers and staff, for any claim, fine, loss or legal cost that comes from the funnels you publish, the data you collect, the AI instructions you give and the output you choose to use, the messages you send, or your breach of these terms, including claims from your visitors, ad platforms, regulators or rights holders.

Changes and ending

We may update these terms and the product. If a change to the terms matters, we will email account holders at least fourteen days before it takes effect. Continuing to use Unfunnel after that is acceptance. You can end the agreement at any time by deleting your account in Settings; we can end it for breach of these terms, for non-payment, or with thirty days' notice if we stop offering the service. The sections on ownership, liability, your responsibility to us, and governing law survive the end of the agreement.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, and any dispute will be brought in the courts there. Before suing, each of us agrees to write to the other and spend thirty days trying to sort it out.
